Collaborative Practice – Resolving Legal Issues for Families in Australia

Collaborative practice offers a unique and personalised approach to resolving legal issues, making it an ideal solution for families navigating separation in Australia. Unlike the majority of traditional legal processes, collaborative practice priorities the wants, needs, values, goals, and wishes of the clients, setting it apart as a client-centered approach that can significantly benefit families and legal professionals.

Benefits of Collaborative Practice

Clients have a voice and actively participate in the decision making process, empowering them and giving them a sense of control over their lives. It can also help promote open communication and cooperation between all parties, leading to more amicable and mutually beneficial solutions.

Collaborative practice is an opportunity to consider not just the legal aspects but also the emotional and psychological well-being of the clients and their families, providing a more comprehensive resolution process.

When clients are allowed to drive the process, it can lead to more satisfied clients and a sense of achievement in helping them transition to the next stage of their lives.

One of the major reasons I trained in collaborative practice was my belief that it would foster a more positive and respectful relationship between the parties, and the legal professionals by ensuring that the focus is on understanding and meeting the clients' needs.

Complex high net worth or multiple issues and entities, along with diverse financial interests, can particularly benefit from the collaborative method. This approach ensures comprehensive oversight, with inputs from accountants, financial advisors, lawyers, and other holistic assistance, fostering a collaborative environment rich in intellect and expertise.

Historical Context and Key Figures

Collaborative practice was pioneered by Stu Webb, a visionary lawyer who emphasised a client-centered approach to resolving legal issues. His foundational ideas have evolved into the sophisticated settlement process known today. Influential figures like Nancy Cameron, Pauline Tesler, and Peggy Thompson have authored books that provide valuable insights and practical guidance on collaborative practice, highlighting its importance in shifting the framework of divorce and separation cases.

As legal practitioners, it’s important that we describe collaborative practice to new clients, with emphasis that its a client-centered approach and focus on meeting their wants, needs, values, goals, and wishes. Collaborative practice prioritises the clients' interests, promoting open communication and cooperation. This method offers a more holistic and personalised approach to resolving legal issues, ensuring that clients are educated, empowered, and maintain a sense of dignity throughout the process.

Addressing Client Concerns

During client interactions, a collaborative practitioner listens to the clients questions, worries, and thoughts. Collaborative practice can address several concerns, such as:

  • Reaching a Fair Outcome and Ensuring equitable settlements.

  • Minimising Impact on Relationships and Preserving family relationships and reducing conflict.

  • Potentially lowering legal costs compared to adversarial processes.

By comparing the adversarial legal process, particularly the court system, with collaborative practice, collaborative practice offers more ideal outcomes, shorter timeframes, less negative impact on relationships, and potentially lower costs.

Legal professionals who understand and incorporate the principles and foundations of collaborative practice can provide a more holistic and satisfactory experience for their clients.

By leveraging the insights from leading collaborative professionals and focusing on client-centered methods, lawyers can effectively integrate collaborative practice into their services, delivering superior outcomes for separating families.
